Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of foebcon.com and the FOBECON AI quantity takeoff platform (together, the "Service"), operated by FOBECON Inc. ("the Company," "we," "us," or "our"), located at 152 Teheran-ro, Gangnam-gu, Seoul 06236, South Korea. By creating an account or otherwise using the Service, you agree to be bound by these Terms. Nothing in these Terms limits any statutory rights you may hold under the laws of your country of residence.

2. Description of Service

FOBECON provides an AI-powered construction estimating tool that accepts uploaded PDF drawing sets - including floor plans, elevations, sections, and construction details - and returns automated quantity takeoffs and bills of quantities in Excel, CSV, or PDF format. The Service is intended for use by construction professionals, including general contractors, quantity surveyors, and estimating teams.

Takeoff output generated by the Service is intended to assist professional estimating workflows. Contractors and quantity surveyors remain responsible for reviewing output, verifying quantities against project requirements, and exercising professional judgement before relying on any output for tendering, contracting, or procurement decisions.

3. Use of the Service

• You must be of legal age in your jurisdiction to enter into a binding contract, or have the authorisation of a legal entity on whose behalf you are acting.
• You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any account, system, or network connected to the Service.
• You may not scrape, reverse-engineer, decompile, or copy any part of the Service except as permitted by mandatory applicable law.
• You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
• You agree to upload only drawing files you have the right to process and to comply with any confidentiality obligations applicable to those files.

4. Intellectual Property

The Service, including the underlying AI models, software, interfaces, and documentation, is owned by FOBECON Inc. or its licensors and is protected by South Korean and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes in accordance with these Terms. No other rights in the Service are granted.

You retain ownership of the construction drawing files you upload. You grant us a limited licence to use, store, and process those files solely to provide the Service to you.

5. Subscription and Payment

Access to the Service requires a paid subscription (or a free trial where offered). Subscription fees are as set out on our pricing page and are charged in advance for each billing period. Fees are non-refundable except as required by applicable law or as otherwise stated in our pricing terms. We reserve the right to change subscription fees on reasonable notice; continued use of the Service after a fee change constitutes acceptance of the new fees.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties to the maximum extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Quantity takeoff output generated by the Service is produced by automated AI analysis and does not constitute professional quantity surveying advice. Mandatory consumer warranties applicable in your country of residence are not affected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total cumulative liability arising from or related to the Service - whether in contract, tort, or otherwise - will not exceed the greater of (a) the total fees you paid for the Service in the twelve months immediately preceding the claim, or (b) USD 100. This limitation does not apply to liability that cannot be excluded or limited under mandatory applicable law.

8. Indemnification

You agree to indemnify and hold harmless FOBECON Inc., its directors, employees, and contractors from and against any claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any third-party right, or any content you submit through the Service.

9. Termination

We may suspend or terminate your access to the Service if you breach these Terms or engage in conduct that we reasonably determine to be harmful to the Service or to other users. You may cancel your subscription at any time via your account settings. On termination, sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-law provisions.

Disputes arising out of or in connection with these Terms are subject to the non-exclusive jurisdiction of the competent courts located in Seoul, South Korea, without prejudice to any mandatory consumer-protection rights you hold under the laws of your country of residence.

11. Changes and Contact

We may update these Terms from time to time. We will post the revised Terms at this URL with an updated "Last updated" date. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.
